3. Usage
To register as a user of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You can review your details by signing into the User Login section of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
4. Payment
You can pay usage fees by any Mastercard or Visa credit card, or Maestro, Visa Electron, Delta, Switch, Laser or Solo debit cards. Your credit/debit card details can be entered on the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE. The details will be encrypted to minimise the possibility of unauthorised access or disclosure.
At the time of registration, your credit/debit card will be charged for the profile fee. Details of pricing are shown within the sign-up process. Prices are expressed inclusive of any VAT payable.
Any reduction or increase in the usage price will take effect on your next usage following notification.
5. Password and Security
If you register to become a user of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services immediately.
If McKeith Research Limited has reason to believe that there is likely to be a breach of security or misuse of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE, we may require you to change your password or we may suspend your usage in accordance with paragraph 11 below.
6. Excluded Services
The services provided by the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE do not include the provision of computer or other necessary equipment to access the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE. To use the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.
7. Intellectual Property

Although McKeith Research LImited aims to offer you the best service possible, McKeith Research LImited makes no promise that the services at the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE will meet your requirements. McKeith Research LImited cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to Customer Services and we will attempt to correct the fault as soon as we reasonably can.
Your access to the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. McKeith Research Limited will attempt to restore the service as soon as it reasonably can.
9. Cancellation of Usage
GILLIAN McKEITH'S PERSONAL HEALTH PROFILE – PAY AS YOU GO SERVICE
McKeith Research Limited may suspend or cancel your usage of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
If you wish to cancel your usage of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE service, you can do so. Cancellation of usage must be received within 7 days of payment to qualify for a refund. If your cancellation notice is received within the 7 days you will receive a refund less the equivalent of 25% of the usage fee. McKeith Research Limited will keep this payment as the fee for having already created your personal profile and because, by requesting usage, you are agreeing that we will make the users' services on the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE available to you immediately. After 7 days the charge for the use of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE is non-refundable.
GILLIAN MCKEITH'S CLUB – MEMBER SERVICE
McKeith Research Limited may suspend or cancel your usage of the GILLIAN MCKEITH'S CLUB immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
The minimum term for a subscription to the GILLIAN MCKEITH'S CLUB is three months. If you wish to cancel your usage of the GILLIAN MCKEITH'S CLUB service after the minimum three month period has elapsed you can do so using the automated cancellation service. To use this service log on to the website and navigate to your MyAccount page. At the bottom of the page a link will display allowing you to cancel your membership. The cancellation will take immediate effect and you will receive a cancellation email to confirm the action. The cancellation link will not display if the minimum membership period has not been completed. If you cancel near the end of your billing period and are inadvertently charged for the next period's fee, contact the Support Team to have the charges reversed.
The GILLIAN MCKEITH'S CLUB subscription consists of a Joining Fee and monthly payment. Refunds will only be made against the monthly fee, refunds of the Joining Fee can not be made.
The GILLIAN MCKEITH’S CLUB provides the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE Service as part of the membership. No individual fee is charged for the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE Service during the period of a membership. Therefore, refunds for PERSONAL HEALTH PROFILES that have been completed during the period of a membership can not be provided.
The suspension or cancellation of your usage and your right to use the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE AND/OR GILLIAN MCKEITH'S CLUB shall not affect either party's rights or liabilities.
Other paragraphs of these Terms and Conditions shall survive cancellation.
10. Health - Caution In Use Of The Site
McKeith Research Limited strongly recommends that you should seek medical advice before starting any weight loss, health or nutritional programme. The information on the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE does not offer medical advice or act as a substitute for medical treatment. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
The Companys liability to you shall in no event exceed the amount of the products in dispute.
12. Refund Policy
GILLIAN McKEITH'S PERSONAL HEALTH PROFILE – PAY AS YOU GO SERVICE
If you are not totally satisfied with your GILLIAN McKEITH'S PERSONAL HEALTH PROFILE you can write to us within 7 days of the date you completed the Profile explaining why you are not happy and you will receive a refund of the amount you have paid for the service less 25% usage fee. Refunds will only be made to the debit/credit card originally used for payment.McKeith Research Limited will keep this payment as the fee for having already created your personal profile and because, by requesting usage, you are agreeing that we will make the users' services on the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE available to you immediately. After 7 days the charge for the use of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE is non-refundable

McKeith Research Limited is not responsible for content on the Internet or World Wide Web pages on any other site or publication outside the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE (unless initially approved by McKeith Research Limited).
14. Advertising and Sponsorship
Part of the GILLIAN McKEITH'S PERSONAL HEALTH PROFILE may contain advertising and sponsorship. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
